About one month after the Supreme Court unanimously held that prohibiting the possession of non-dried forms of medical marihuana unjustifiably limits the s. 7 Charter right to liberty, Health Canada issued a s. 56 exemption under the Controlled Drugs and Substances Act to allow licensed producers to sell fresh marihuana buds and leaves and cannabis oil in addition to the original dried form.
